To use TravelNest, you must be at least 13 years of age. If you are between 13 and 17 years of age, you confirm that a parent or legal guardian has reviewed and consented to these Terms on your behalf. By using the Application, you represent and warrant that you meet these eligibility requirements.

You may create an account using an email address and password, or via Google Sign-In. You must provide accurate, current, and complete information during registration and keep your account details up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at thenestlab.support@gmail.com if you suspect any unauthorised access to your account. The Nest Lab is not liable for any loss or damage resulting from your failure to safeguard your credentials.

TravelNest provides tools to help you organise and plan travel. All itineraries, suggestions, schedules, and recommendations generated by the Application — whether by AI or otherwise — are provided for informational and planning purposes only. They do not constitute professional travel advice.

You are solely responsible for independently verifying all travel-related information before making any bookings or decisions, including but not limited to:

• Flight schedules, availability, and booking status
• Hotel availability, pricing, and cancellation policies
• Visa requirements and entry restrictions for your destination
• Passport validity requirements
• Travel insurance requirements and coverage
• Attraction opening hours, admission prices, and availability
• Local health, safety, and travel advisories
• Currency exchange rates and payment methods

The Nest Lab is not responsible for any travel disruptions, cancellations, delays, overbookings, visa denials, missed connections, or any other travel-related issues that may arise. All travel bookings remain the sole responsibility of the user and the relevant travel service providers.

TravelNest uses artificial intelligence to generate personalised travel itineraries, packing lists, budget estimates, activity suggestions, and related content. This content is produced algorithmically based on the information you provide and general travel data. It is not reviewed or verified by a qualified travel professional before being presented to you.

AI-generated content may:

• Contain factual errors, outdated information, or inaccuracies
• Suggest attractions, restaurants, or experiences that have closed or changed
• Underestimate or overestimate travel times, costs, or availability
• Fail to account for seasonal variations, local events, or current conditions

You acknowledge that AI-generated content is a starting point for your planning, not a definitive guide. You must independently verify all material information — including opening times, prices, booking requirements, and travel logistics — before relying on it for actual travel.

TravelNest offers a free tier with limited features and optional paid premium subscriptions, currently available as a monthly plan and a yearly plan. Details of what each plan includes are displayed within the Application and may be updated from time to time.

Premium subscriptions are billed in advance on a recurring basis (monthly or yearly, depending on your chosen plan). Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. By subscribing, you authorise us to charge your payment method on a recurring basis.

Current subscription pricing is displayed within the Application at the time of purchase. All prices are inclusive of applicable taxes where required. The Nest Lab reserves the right to change subscription prices. We will give you reasonable advance notice of any price changes, and your continued subscription after the effective date constitutes acceptance of the new price.

You may cancel your premium subscription at any time through the Application (Settings → Subscription → Cancel Subscription) or by contacting us at thenestlab.support@gmail.com. Cancellation takes effect at the end of your current billing period. You will retain access to premium features until the expiry of your paid period. Cancelling your subscription does not automatically refund fees already paid for the current period.

If you delete your TravelNest account while you have an active premium subscription, that subscription is scheduled to cancel at the end of its current billing period on the same terms — no automatic refund is issued, and premium access continues until your paid period ends. Full account deletion behaviour, including two platform limitations, is set out in our Privacy Policy.

Subscription fees are generally non-refundable except where required by applicable law. If you believe you have been charged in error, please contact us at thenestlab.support@gmail.com within 14 days of the charge and we will review your request. Refunds, where granted, will be made to the original payment method.

If you are a consumer in the European Union, you may have a right of withdrawal within 14 days of your initial purchase, subject to applicable consumer protection law. This right may not apply if you have already begun using the premium service within that period.

The free tier permits a limited number of saved trips and restricts access to certain premium features. The Nest Lab reserves the right to adjust free tier limitations at any time with reasonable notice.

You retain full ownership of all content you upload or create within TravelNest, including travel documents, photos, journal entries, and trip notes ("User Content"). By uploading User Content, you grant The Nest Lab a limited, non-exclusive, royalty-free licence to store, display, and process that content solely for the purpose of providing you with the Application's services.

You are solely responsible for:

• The accuracy, completeness, and legality of any documents or files you upload
• Ensuring you have the right to upload and store any content within the Application
• Not uploading content that infringes third-party intellectual property rights or violates applicable law
• Not uploading content belonging to other individuals without their consent

While we take reasonable technical measures to secure uploaded documents (as described in our Privacy Policy), you acknowledge that no storage system is entirely risk-free. We strongly recommend maintaining your own secure copies of all important travel documents.

The Nest Lab reserves the right to remove User Content that violates these Terms, applicable law, or our Acceptable Use Policy, and to suspend or terminate accounts responsible for such content.

The Application, including its design, code, content, branding, logos, trademarks, and AI models, is the exclusive property of The Nest Lab and is protected by copyright, trademark, and other applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

Subject to your compliance with these Terms, The Nest Lab grants you a limited, non-exclusive, non-transferable, revocable licence to access and use TravelNest for your personal, non-commercial use only.

If you submit suggestions, ideas, or feedback about TravelNest (including through our beta feedback form), you grant The Nest Lab a perpetual, irrevocable, royalty-free licence to use, implement, and incorporate that feedback into the Application without any obligation to you.

TravelNest is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, error-free, or continuous access to the Application. The Application may be temporarily unavailable due to maintenance, updates, technical failures, or circumstances beyond our control.

We reserve the right to perform scheduled or emergency maintenance at any time. Where possible, we will provide advance notice of planned downtime through the Application or by email.

The Nest Lab reserves the right to modify, add, remove, or discontinue any feature of TravelNest at any time. We will endeavour to give reasonable notice of material changes that affect premium features. Where a feature you paid for is permanently removed, we will assess whether a pro-rata refund or credit is appropriate.

Features marked as "beta" or provided during a beta testing period are experimental and provided without warranty. Beta features may be unstable, incomplete, or subject to change or removal without notice.

To the maximum extent permitted by applicable law, TravelNest is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

The Nest Lab expressly disclaims all liability for any loss, damage, cost, or expense — direct, indirect, consequential, or otherwise — arising from:

• Travel disruptions, cancellations, delays, or overbookings by airlines, hotels, or other travel providers
• Missed flights, missed connections, or missed reservations
• Visa denials, passport issues, or entry refusals
• Inaccuracies in AI-generated itineraries or recommendations
• Decisions made based on information presented in the Application
• Loss or theft of travel documents stored in the Application
• Service unavailability or data loss due to technical failures

To the extent permitted by law, The Nest Lab's total cumulative liability to you for any claim arising from or relating to these Terms or your use of TravelNest shall not exceed the total amount you paid to The Nest Lab in the 12 months immediately preceding the event giving rise to the claim, or €50 (whichever is greater).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or any statutory consumer rights you may have.

You may delete your TravelNest account data at any time through the Application settings or by contacting us at thenestlab.support@gmail.com. Upon account deletion, your TravelNest application data is handled in accordance with our Privacy Policy (see Section 8.3 of the Privacy Policy for the accurate, detailed behaviour, including the platform limitations on full login-identity deletion and residual hosted files). Any active premium subscription is cancelled at the end of its current billing period with no automatic refund; subscription fees already paid will not be refunded except as described in Section 6.5.

The Nest Lab reserves the right to suspend or permanently terminate your account, with or without notice, if:

• You breach these Terms or our Acceptable Use Policy
• We are required to do so by law or a regulatory authority
• We reasonably believe your account is being used fraudulently or to harm others
• Your account has been inactive for an extended period (we will provide reasonable notice before closing inactive free accounts)

Upon termination, your right to use TravelNest ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 9, 11, 14, and 15) shall continue in full force and effect.

These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law provisions. Where applicable, EU consumer protection laws shall also apply to users within the European Union.

In the event of any dispute arising from or relating to these Terms or your use of TravelNest, we encourage you to contact us first at thenestlab.support@gmail.com to seek an amicable resolution. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of Malta, unless you are a consumer resident in the EU, in which case you may also bring proceedings in the courts of your country of residence.

If you are an EU consumer, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Nest Lab regarding your use of TravelNest and supersede all prior agreements.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We may update these Terms from time to time. We will notify you of material changes via email or through a prominent notice in the Application at least 14 days before the changes take effect. Your continued use of TravelNest after the effective date constitutes acceptance of the updated Terms.
